Moon Report: Repeal Section 13

Richard Moon was commissioned by the Canadian Human Rights Commission (CHRC) to review its conduct. Today Moon released his report and recommendations.

1. The first recommendation is that section 13 of the CHRA be repealed, so that the CHRC and the Canadian Human Rights Tribunal (CHRT) no longer deal with hate speech, and in particular hate speech on the Internet. Hate speech should continue to be prohibited under the Criminal Code2 but this prohibition should be confined to expression that advocates, justifies or threatens violence.

Section 13 of the Canadian Human Rights Act has been used with much controversy by the CHRC to suppress "hate speech". The CRHC has been accused of acting like a Kangaroo Court and restricting free speech with its Section 13 rulings.

More on the significance of this ruling from Ezra Levant, who knows all too well what it's like to be accused under Section 13 of the CHRA. Levant also has a column in tomorrow's National Post. And he explains how the CHRC has set out to bury the Moon report.

Despite the contractual obligations on Moon to have his report cleared (twice) by Lynch, he apparently stuck to his guns.

There remain other flaws with this report, and I’ll discuss them later. But that’s not important right now. What’s important is that Richard Moon, Jennifer Lynch’s hand-picked white-washer, didn’t do what he was expected to do (expected to do by me or by Lynch!)

Will Lynch and her fellow bullies now concede defeat? Are you kidding? And admit that they’ve been conducting themselves inappropriately for thirty years? And admit that they are violators of human rights, not protectors of them? And lose all that power over people – the power to destroy and humiliate? And lose staff and budgets?

If so, then you don’t understand that being a bully is in the DNA of human rights thugs.

Lynch is already trying to throw Moon under the bus.

In her press release announcing his report, which you can see here, you’ll notice something is missing: Moon’s recommendation to repeal section 13. He uses the phrase repeal again and again in his report – but you won’t find it in Lynch’s revisionist press release.

I'll skip the obvious puns here about how the CHRC got "mooned" by its own expert. Or how the CHRC's chief commissar (Jennifer Lynch) is responding with a "Lynch mob".

Recently, at the Conservative party’s national policy convention delegates voted to repeal Section 13. And Liberal MP Keith Martin has re-introduced a private member's motion to repeal Section 13 of the Canadian Human Rights Act.

OHRC drops complaint against MacLeans

The Ontario Human Rights Commission today made the right decision:

TORONTO, April 9 /CNW/ - The Ontario Human Rights Commission has decided not to proceed with complaints filed against Maclean's magazine related to its publication of an article "The future belongs to Islam."

It's the right decision, but obviously the OHRC commissioners were not very happy about it. Author of the book America Alone, from the which the MacLean's article was an excerpt, Mark Steyn explains:

Of course, being apparatchiks of the pseudo-"human rights" establishment, they couldn't leave it at that. So they added the following:

While freedom of expression must be recognized as a cornerstone of a functioning democracy, the Commission strongly condemns the Islamophobic portrayal of Muslims, Arabs, South Asians and indeed any racialized community in the media, such as the Maclean’s article and others like them, as being inconsistent with the values enshrined in our human rights codes. Media has a responsibility to engage in fair and unbiased journalism.

So in effect the Ontario "Human Rights" Commission, the world leaders in labiaplasty jurisprudence, have decided that, even though they don't have the guts to hear the case, they might as well find us guilty. Ingenious!

The OHRC has been forced to admit that it would be overstepping it's bounds in cases like this. In it's own words:

However, the Ontario Human Rights Code does not give the Commission the jurisdiction to deal with the content of magazine articles through its complaint process.

It's good to see the powers of the OHRC reigned in a bit. It's a start.

Update: Oops, just when it looked like free speech was making a comeback, we get news that infamous former CHRC employee and anti free-speecher Richard Warman has filed a defamation lawsuit against Ezra Levant, bloggers Kate McMillen, Kathy Shaidle and others including the conservative chat site Free Dominion, the National Post and it's publisher Jonathan Kay.

The whacky world of the Canadian Human Rights Commission

The dirt is coming out about the thought police who staff the Canadian Human Rights Commission:

Bumbling secret agent Maxwell Smart is alive and well, and works for the Canadian Human Rights Commission. And under an assumed name, it seems.

Even those of us advocating human rights commission reform, and thus inclined to think the less of them, have been amazed this week by what goes on at the CHRC, as revealed by a tribunal prosecuting alleged hatemonger Marc Lemire.

There we were, making abstract arguments about free speech and quoting Voltaire.

There the federal snivel servants were, logging onto Internet hate sites under assumed names, trying to conceal what they were up to by using the wireless Internet account belonging to a young woman who seems to be completely uninvolved in any of it and, according to Lemire, trying to entrap people who visited his site.

Only the unusual circumstance of these people being publicly cross-examined brought any of this to light.

Boy, did we ever not quite get it. We thought this was a high-minded disagreement over fundamental principles. Instead, we find the CHRC tolerates sleazy behaviours among its investigating officers that have no place in a free society.

G&M blasts HRCs

Is the main stream media awakening to the assault on freedom of speech in Canada? Here's some welcome support in this editorial from the Globe and Mail, via PWGSC:

There are those who disagree vehemently with Mark Steyn and Ezra Levant. Both men are staunch conservatives whose success is built largely upon the ability to provoke. Mr. Steyn is a brilliant writer who sometimes pushes the boundaries of mainstream opinion; Mr. Levant is an unabashed self-promoter. Yet even those Canadians who take issue with the opinions or methods of Messrs. Steyn and Levant should be more offended by the gross overreaching of this country's human-rights commissions in investigating the two men's work.

Comment by Ezra:

Congratulations to Martin for doing the right thing. But more than that: he has given the government itself a political opening to amend this awful law. The Conservatives should ensure that Motion M-446 goes to a vote, and every one of them -- as well as other MPs of good faith from every party that cares about freedom -- should join with Martin to make his amendment law.

Be sure to let your Member of Parliament know that he/she should support this motion.

Rex defends free speech in Canada

Rex Murphy muses about what might happen if Canada's Human Rights Commissions become too preoccupied with their persecutions of Ezra Levant and Mark Steyn...

Mostly I fear, if the HRCs are tied up, Canadians will be reading, unguided, what they choose to read, deciding for themselves what they like and what they don't, will discard a book or pass it to a friend, like a column or curse one - lit only by the light of their own reason.The horror! Before we know it, we'll have an unstoppable epidemic of free speech, free thought, and freedom of the press. And, surely, no one wants that. Otherwise, why would we have human rights commissions?
